The European Data Protection Board (EDPB) has just published its Guidelines 01/2022 on data subject rights – Right of access open for public consultation until March 11th, 2022.

The “right of access”, described in article 15 of the General Data Protection Regulation (GDPR), is one of the most exercised rights by individuals since it allows them to obtain confirmation as to whether their data is processed or not and to gain access to their personal data and to relevant information about the processing.
Through an extensive analysis of what falls within the scope of the “right of access” and a comprehensive flowchart describing how to interpret, assess and answer the request as well as how to check limits and restrictions based on certain criteria and contexts, this Guideline aims to consider the whole life cycle of the right. Completeness and correctness of the information, time reference point of the assessment and compliance with data security requirements are the key principles to be respected.
Finally, the Guideline gives useful insight for the exercise of data subjects’ rights in a broader sense.
